Terms of Service

The agreement between you and Esperaly for use of our website and queue management software.

Agreement

By accessing https://esperaly.com or creating an Esperaly account, you agree to these Terms of Service. If you are using Esperaly on behalf of an organisation, you confirm you have authority to bind that organisation.

The service

Esperaly provides browser-based queue management tools, including tickets, counters, kiosks, displays, and related dashboards. Features may change as we improve the product. Beta or experimental features may be less reliable and can be withdrawn.

Accounts and responsibilities

You are responsible for the accuracy of account information, safeguarding login credentials and device PINs, and all activity under your organisation.

You must use Esperaly lawfully and must not attempt to disrupt the service, probe systems without authorisation, resell access without our written permission, or upload unlawful or infringing content.

You are responsible for notices, consents, and compliance required for data you collect from your customers through tickets, kiosks, or forms.

Subscriptions and billing

Paid plans are billed according to the pricing shown at signup or in the product (typically per counter per month) unless otherwise agreed in writing. Trials convert to paid plans unless cancelled before the trial ends, where a trial is offered.

Fees are processed by Stripe. Taxes may apply. Unless required by law, fees are non-refundable once a billing period has started.

We may suspend or terminate access for non-payment or material breach of these terms.

Acceptable use of guest-facing surfaces

Kiosks, join links, tickets, and displays are for your legitimate queue operations. You must not use them to phish, spam, or mislead guests. You must keep join URLs and public devices under your control.

Intellectual property

Esperaly and its branding, software, and documentation remain our property or that of our licensors. You receive a limited, non-exclusive licence to use the service during your subscription. You retain ownership of your organisation content and queue data.

Privacy

Our Privacy Policy explains how we handle personal information and forms part of how you use Esperaly.

Disclaimer

The service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.

Limitation of liability

To the fullest extent permitted by law, Esperaly will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data.

Our aggregate liability arising out of or related to the service will not exceed the amounts you paid to Esperaly for the service in the three months before the claim.

Termination

You may stop using Esperaly and cancel according to product billing controls. We may suspend or terminate access immediately for breach, abuse, legal risk, or prolonged non-payment. Provisions that should survive termination (including IP, disclaimers, and liability limits) will survive.

Changes

We may update these terms by posting a revised version on this page and updating the “Last updated” date. Material changes may also be communicated by email or in-product notice. Continued use after the effective date constitutes acceptance.
